BLB2120 LEGAL WRITING AND DRAFTING (1st – 12th of December)

Professor Henry Gabriel, Loyola University, New Orleans

This unit of study teaches students the principles of good legal writing. It includes but is not limited to logical presentation of arguments, how to effectively use material from research, logically analyse case law, present and drafter a legal document and interpretation of cases in order to strengthen logical arguments.

ABOUT THE LECTURER
Henry Gabriel is the DeVan Daggett Professor of Law at Loyola New Orleans and is currently serving as Distinguished Visiting Professor at Elon University. He is on the Governing Council of the International Institute for the Unification of Private Law (UNIDROIT) in Rome and he is a delegate from the United States to the United Nations Commission on International Trade Law.

BLB4141 INTERNATIONAL TRADE LAW (12th – 30th of January)

Professor Gabriel Moens, Murdoch University, Perth

This unit of study contains two parts: the first part is a general introduction to the sources of international law, the nature of international trade law and the scope of international trade law specifically the CISG and the UNIDROIT Principles; the second part covers a number of topics focusing on the INCOTERMS2000 and the UCP600.

ABOUT THE LECTURER
Professor Moens is Dean and Professor of Law, Murdoch University School of Law. Before taking up his present position he was Professor of Law and Head, Graduate School of Law, University of Notre Dame, Australia. He also served as Garrick Professor of Law and Director, The Australian Institute of Foreign and Comparative Law, The University of Queensland. He undertakes teaching and research in Constitutional Law, Banking Law, European Union Law, International Commercial Law, International Arbitration Law and Comparative Law. He also teaches International Business Law and European Union Law at the University of Notre Dame, London Law Centre.

BLB3133 COMPARITIVE COMMERCIAL LAW (9 – 20th of February)

Professor Karl-Michael Schmidt, Humboldt University, Berlin

This unit of study will examine one or more areas of commercial law from a comparative point of view. Civil law and common law solutions to varies areas of law such s contract law, torts and corporate law will be analysed and explained.

ABOUT THE LECTURER
Rechtsanwalt (Attorney at Law), Director of the Institut für Anwaltsrecht an der Humboldt-Universität zu Berlin“. At Humboldt University he is lecturing civil law and civil procedure with a special focus on contract law, international private law, conflict of laws, arbitration, ADR (Alternative dispute resolution – mediation, negotiation), corporate and commercial law. He is responsible for the law faculties mooting programs on domestic contract law and international trade law. He is the Co-Director for the Humboldt University of the annual “International Summer School on Alternative Dispute Resolution” jointly organized by Humboldt University and the Tulane Law School, New Orleans.

BLB4142 ADVANCED LEGAL RESEARCH DISSERTATION

The unit of study involves advanced legal research and writing on a topic of the student's choice. In consultation with their supervisor, students select their own research topics and formulate their research program. The topic should not duplicate a topic undertaken by a student in respect of coursework units of study for which a significant paper was written and submitted. The research and writing must be completed during one semester under the supervision of a member of staff and will involve the writing of a research paper of between 5000 and 8000 words.
